As a property owner it’s almost inevitable that you’ll require the services of a professional tenant debt collection agency at some point. But why?
Well, debt collection can get pretty nasty at times with debtors being harassed, victimised or even assaulted in the name of ‘professional debt collection’. Don’t let the means defeat the purpose.
Court Sanctioned Debt Collection
Under normal circumstances a court hearing your case will issue a writ of execution. This is a court order that gives a duly authorised officer of court the power to sell the property of debtors. This normally follows after judgment is given in your favor. It’s therefore ill-advised to sell a tenants property without the requisite court order.
Notice Periods
If you don’t wish to prolong the tenant’s lease then your aim should be to cancel the lease contract. Again, a debt collection agency will be better served if the lease agreement contains a cancellation clause.
A cancellation clause gives you an automatic right to cancel and reclaim your property -eviction- but this should be preceded by a notice of cancellation. Failure to give notice can result in a court deeming an eviction illegal.
